  Summary About the Position: This position is in the District Office located in the heart of beautiful downtown Nashville, TN, the home of country music. It is just a three block walk to the historic Ryman Auditorium and Music Row, where you will conduct legal research, render legal opinions and furnish legal advice on the District mission including permits, Acquisition, Freedom of Information Act, Non-contractual Claims, Reports of Survey, AR15-6 Investigations, and Travel Reimbursement Irregularities. Responsibilities Perform as legal advisor and functional expert for labor and employment law matters to District Commander, management officials, and Equal Employment Opportunity Manager. Render advice to District personnel on policies and procedures concerning the Freedom of Information and Privacy Acts and regulations. Furnish legal advice on the preparation of solicitations of formally advertised and negotiated contracts. Represent the Government as trial attorney in contractual appeals before the Corps of Engineers or the Armed Services Board of Contract Appeals. Review Reports of Survey and appeal files recommending pecuniary liability and give opinions as to the adequacy of the evidence and propriety of findings and recommendations. Render legal advice and guidance concerning suspected travel reimbursement irregularities. Furnish legal interpretations on provisions of permit laws and regulations, and numerous other Federal, State, and local laws and regulations impacting on the regulatory program at the District. Compile litigation reports (on suits instituted against the Government and/or Government contractors) concerning District activities. Assist U.S. Attorneys in preparing cases for trial and sit at counsel table during trial to furnish information pertinent to the case as may be required. Requirements Conditions of Employment Qualifications Who May Apply: US Citizens In order to qualify, you must meet the education and experience requirements described below. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community; student; social). You will receive credit for all qualifying experience, including volunteer experience. Your resume must clearly describe your relevant experience; if qualifying based on education, your transcripts will be required as part of your application. Additional information about transcripts is in this document. The minimum qualification requirements must be met before applicants are eligible for further consideration: Education: In order to qualify for this position, you must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA), and have the first professional law degree (LLB or JD). Bar Membership: Applicant must currently be a member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico. Experience: Applicant must have two or more years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position. The statement "commensurate with the duties and responsibilities of the position" means the hiring authority is specifically seeking candidates with Government procurement experience. Time-In-Grade Requirements: If currently employed as an Attorney in the Federal Government, must have completed at least one year at the next lower grade level (GS-12). Specialized Experience: In addition to your questionnaire answers, your resume must address any specialized experience you possess in the following areas: (1) Exercising discretion and independent judgment in the application of laws, regulations, precedents, and agency practices, (2) Providing legal advice and representation related to labor and employment law matters, and Freedom of Information Act Claims, (3) Furnishing counsel and guidance on procurement matters including issues of law and fact regarding procurement methods, government policies, appropriate legal authorities, types and forms of contracts, and the various consequences of the contract types and terms and conditions under consideration, (4) Advising on regulatory matters and furnishing legal advice on applications for Department of Army permits under the River and Harbor Act of 1899, the Clean Water act, and implementing regulations, (5) Preparing cases for trial and/or the trial of cases before a court or administrative body or persons having quasi-judicial authority. Experience includes preparation of responses, obtaining evidence, conducting depositions, preparation of briefs, motions, witness stipulations and other documents, as well as conducting the case before the judge or hearing officer, (6) Functioning effectively as a counselor and advisor to senior officials and project delivery teams within the Corps of Engineers, and to work with private entities, local and state governments, and other federal agencies, at the highest levels, (7) Identifying, researching, evaluating and analyzing facts and complex legal issues in order to advise on policies and procedures concerning the Freedom of Information and Privacy Acts and regulations, VETERANS PREFERENCE INFORMATION: There is no formal rating system for applying veteran's preference to attorney appointments in the excepted service; however, the Department of the Army considers veteran's preference eligibility a positive factor for attorney hiring. Applicants eligible for veteran's preference must include that information in their cover letter or resume and attach supporting documents (e.g., DD Form 214, Certificate of Release or Discharge from Active duty) to their submissions. Although the point-preference system is not used, applicants eligible to claim a 10-point preference must submit a Standard Form (SF) 15, Application for 10-Point Veteran Preference, and supporting documentation required for the specific type of preference claimed. (SF 15, which lists the types of 10-point preference and the required supporting documents, is available from the Office of Personnel Management Website at http://www.opm.gov/.) Education FOREIGN EDUCATION: If you are using education completed in foreign colleges or universities to meet the qualification requirements, you must show the education credentials have been evaluated by a private organization that specializes in interpretation of foreign education programs and such education has been deemed equivalent to that gained in an accredited U.S. education program; or full credit has been given for the courses at a U.S. accredited college or university.
