The role of the hearing officer for the Professional Practices AdvisoryCommittee is one of a facilitator. The hearing officer is not anappointed member of the committee, does not have voting rights, and hasonly limited decision-making authority. The committee members areresponsible for evaluating the evidence and making a finding of fact,conclusions of law, and recommendations to the Board.
Roles & Responsibilities
The Director of Enforcement is the liaison for the hearing officer,advises the hearing officer on their role and responsibilities, andwrites the findings of fact, conclusions of law, and recommendations.
Role As the facilitator of the meeting, it is the responsibility of thehearing officer to handle the following for each case:
Call the meeting or prehearing to order Introduce the case
Call the roll call
Communicate with the respondent or attorney about the process ofadministrative hearings Admission of evidence
Swear in of all witnesses
Ensure the hearing follows Roberts rules Guide each step of the process
Guide the discussion around the findings of fact, conclusions of law,and recommendations
Confirm all recommendations and call for a roll call vote
Confirm the vote and final recommendation to the Board for the recordclose or continue the hearing for each case
Occasionally the hearing office will be asked to approve or deny acontinuance request if it falls past a specifically set deadline,depending on the type of hearing.
Also, occasionally the committee will request additional documents orthere is evidence that will be presented during the hearing as a lateand supplemental exhibit.
The hearing officer will discuss the evidence with the party presentingit to determine its value to the hearing and legitimacy for the latesubmission and the committee will vote on the admission of thosedocuments or the evidence in question.
The hearing office is responsible for reviewing each case, evidence, andapplicable case law prior to the hearing.
The hearing office is not responsible for writing or editing anyreports, findings of fact, conclusions of law, or recommendations
Required Experience - Prior experience with the Arizona State Board ofEducation.
