The incumbent will carry out a range of functions and tasks in support of the Abbott legal team in India under the direct supervision of Associate Director-Legal. Some of the key responsibilities include -
Managing the vast trademark portfolio of Abbott India and provide all support starting with coining the trademark to search, adoption and prosecution of marks in coordination with external counsel.
Conduct trademark search, work with Business for evaluation, finalization of brand names and making proactive and pragmatic suggestions in brand adoption.
Coordinate and correspond with external lawyers for trademark application, objection, opposition, rectification before Trademark Registry and provide requisite information/clarification to external counsels in relation with such proceeding. Regularly monitoring registered trademarks and initiating necessary actions for renewing registrations.
Screening of the trademark journal to identify similar and deceptive marks and take necessary action to prevent others and protect company trademarks. Engage with internal stakeholders for collating data and evidence in connection with various trademark proceeding and assist licensing partners in prosecution proceeding pertaining to licensed marks.
Regular monitoring, administering trademark records in trademark global software and periodically update/streamline the India database.
Collaborate with the packaging division, review artworks and providing trademark related advice and suggestions in terms of product labelling.
Assess the risk and advise on trademark, various marketing initiatives, packaging and labelling of products from time to time.
Collaborate and closely work with Global trademark teams at Basel and Chicago on trademark related activities involving products, strategies, policies and initiatives etc.
Participate in meetings, make presentations to the Global Trademark teams on important issues, highlight the business operations, updates on relevant laws and judgements pertaining to Trademark and Trademark Laws.
Drafting vetting and negotiating term sheets, assignments and provide necessary support on licensing/acquisition deals from trademark perspective. Conduct comprehensive due diligence of trademarks; suggest trademark strategies and alternatives based on the best possible value proposition with the company. Work closely with the Global Trademark and legal teams at Basel in connection with such deals.
Review of investigation reports, advice, opinions and pleadings drafted by external lawyers in relation to various trademark proceedings. Conduct research on judicial precedents/case laws and work on examination/cross-examinations.
Closely work with external Advocates and brief Counsels in connection with trademark litigations. Evaluate on various legal recourse available to Abbott. Prepare and review of notice, reply, application, petition and written statements etc. File infringement suits against lookalikes and defend such litigations against the company. Assist Regulatory and Global Product Protection team in dealing with spurious and counterfeit cases. Review progress of on-going cases and provide regular updates to seniors.
Attending Court hearing, appear before court for examination, negotiation and formulate litigation strategy in the interest of the organization.
Work as a business partner to business verticals with a solution-based approach, taking an active role in formulating trademark strategy for the Business, in coordination and under guidance of senior team members.
Closely work with Supervisor and Legal team in formulating various standard operating procedures, manuals, policy documents and guidance notes to assist Business associates conducting their assignments in compliance with the Trademark, Legal and Regulatory norms applicable to marketing and promotion of products.
Anticipate the risk and support need of Business from Trademark perspective and help define and drive the strategic plans of the Business.
Keep oneself abreast of the applicable legislations and their changes impacting the business and provide training to non-legal stakeholders on trademark and updates in laws.
Working and interacting with Abbott global and regional colleagues outside India as required from time to time.
Provide legal support to the Business on various routine commercial issues and performing any other task assigned by the supervisor.
SKILL, EDUCATION & EXPERIENCE
LL.B./ LL.M. from a reputed university
Post qualification experience of 10 to 12 years
Work experience on pharmaceutical / healthcare/ food laws would be preferred
Work experience in a reputed law firm for couple of years is desirable
Good academic background is required
Proficiency in English (both written & verbal) as well as excellent communication skills are a must
