  Koniag Professional Services, a Koniag Government Services company , is seeking experienced EEO Counselors to support KPS and our government customer. These roles will be in our Chantilly, VA office, with the opportunity for approved telework.

  Hourly Salary Range: $28.46 per hour to $40.86 per hour, DOE.

  Description: The EEO Counselor shall provide EEO counseling services for informal individual (not class) EEO complaints of discrimination and harassment in accordance with EEOC regulations set forth at 29 CFR Part 1614, EEOC Management Directive (MD) 110 with special emphasis on Chapters 2, 3 and Appendices B-D, and FAA Order 1400.10. These services are for cases filed by aggrieved persons who believe they have been subjected to discrimination and/or harassment on the basis of race, color, religion, sex, national origin, age, disability, sexual orientation, genetic information, pregnancy, or in retaliation for engaging in activities protected by the relevant EEO regulations and statutes.

  The EEO Counselor will conduct counseling sessions regarding informal complaints of discrimination by engaging in the following activities. The primary, although not exclusive, method of conducting an informal counseling inquiry may be video and/or telephonic interviews.

  Follow all Client Counseling Procedures and use appropriate forms and notices.

  Ensure the Aggrieved and Responding Management Official are interviewed with regard to the substance of the claims (conduct a limited inquiry).

  Notify the Aggrieved of their Rights and Responsibilities under the EEO regulations.

  Gather all relevant supporting documents needed to answer jurisdictional questions. (timely, states a claim, is an employee under the 29 CFR 1614 regs., etc.)

  Engage in facilitated negotiation to try to informally resolve issue.

  Write a Counselor’s Report.

  Handle many of their own clerical duties, including scanning, printing, emailing, proofing their own written work, etc.

  Other duties as are necessary to comply with EEO regulations, client contract terms, or internal policy.

  Additional EEO Counselor required duties and performance standards

  Intake – Capture complaint information when an aggrieved person (AP), an FAA employee, an applicant for employment, a former employee or a contractor, desires to enter the EEO precomplaint process. Assign an Intake/EEO counselor to conduct the intake interview. Create and complete Intake entries in the iComplaints Tracking System (iComplaints). The Counselor must complete the National Intake Form (QF-ACR-10).

  Ensure that aggrieved persons understand their rights and responsibilities in the EEO

  Complaint Process, including their right to remain anonymous and right to representation. Send the

  aggrieved person the Rights and Responsibilities Memorandum via certified mail.

  Determine the claim(s) and basis(es) raised by the aggrieved persons.

  Complete a limited inquiry during initial interview to gather information, ensure timeliness

  and to address jurisdictional questions that may arise should the complaint be elevated to the formal

  level.

  Continually seek a resolution of the dispute at the lowest level through discussions with the complainant and relevant management personnel. This includes the use of shuttle diplomacy.

  If participation in EEO ADR results in resolution, the EEO Counselor must document the resolution and place on FAA resolution form.

  Advise the aggrieved persons of their right to file a formal complaint of discrimination if

  attempted resolution is unsuccessful. Send the aggrieved person the Notice of Right to File (NRTF)

  memorandum via certified mail.

  Prepare a report that sufficiently documents contract Counselor’s completion of these

  required counseling actions.

  Progress Reports. The Counselor must provide a bi-weekly progress report to the FAA Complaints Manager during the processing of an informal complaint. The report is due the Wednesday prior to the first Monday of each FAA pay period. If the designated Monday falls on a Federal holiday, the report must be provided on the next business day.

  Counselor Report. The Counselor must provide completed EEO Counselor’s Report to the PM

  within four (4) days of completion of the counseling activities for every case assignment. If the

  4th day falls on a Saturday, Sunday or Federal holiday, the Counselor’s Report must be provided on

  the next business day. This timeframe supersedes the one recorded in the EEO Counseling

  Procedure (ACR-PR-010). The PM’s acceptance criteria for this report will include its compliance with the provisions of this SOW, completeness, accuracy and compliance with all applicable laws, directives and FAA policies and will be 100% free of all grammatical and punctuation errors and/or omissions.

  The Counselor will complete the process on or before the 30th day. If the 30th day falls on a Saturday, Sunday or Federal holiday, the time cannot be extended and counseling must be completed prior to the 30th day.

  Performance Standards

  Counselor is expected to interview the Aggrieved and inform them of their rights and responsibilities under the regulations for federal sector EEO complaint processing and provide them with all appropriate forms.

  Counselor is expected to know EEO laws and regulations and be able to analyze facts and evidence to apply such laws and regulations.

  Counselor is expected to interview the Aggrieved and discern the claim(s) and the basis or bases of the claim(s). If one or more of the claims are not timely, the counselor must include an explanation from the Aggrieved as to why they did not seek counseling sooner.

  Counselor is expected to interview the management official and articulate management’s response in the counselor’s report.

  Counselor is expected to facilitate a negotiation between the Aggrieved and the management official, and to write a signed agreement resolving the issue, when appropriate. The Counselor must determine when a facilitated negotiation is appropriate.

  Due to the nature of this work, the Counselor must be able to work independently and complete tasks in a timely manner. Short deadlines are unavoidable.

  Due dates are critical in counseling work. The counselor must keep track of the deadline for the issuance of the Notice of Right to File and the individual Client’s requirements for the counselor’s report.

  The Counselor must document all interactions between the Intake counselor/EEO counselor and

  other parties relative to the case in iComplaints online case management system that is provided. The Counselor must be prompt in adding the entries into the database. Without exception, all entries must be completed the same calendar day as the incident, interview or meeting occurs of the documentation being received.

  Work Schedule

  Part time, 24 hours per week/3 days a week x 9 hours per day (1 hour lunch period, Monday through Friday. Core hours are 0800 to 1600, ET, M-F. Alternative work schedule is not available.

  Full time, 40 hours per week/9 hours per day (1 hour lunch period), Monday through Friday. Core hours are 0800 to 1600, ET, M-F. Alternative work schedule is not available.

  Position Qualifications

  EEO Counselor candidates must meet and possess independently verifiable mandatory EEO Counselor training requirements as specified in MD-110.

  EEO Counselors must have received a minimum of thirty-two (32) hours of EEO Counselor training. EEO Counselors must possess proof of successful completion of a minimum of eight (8) hours Annual Refresher Training within the last ten (10) months.

  Additionally, the candidate must possess a minimum of two (2) years of EEO counseling experience in the federal sector that is relevant in scope, complexity and magnitude of effort.

  In addition to a detailed knowledge of the EEOC’s regulations (Title 29, CFR §1614), the Counselor must have a thorough, current, superior knowledge of the following authorities as they relate to the processing of EEO employment discrimination complaints:

  Title VII of the Civil Rights Act of 1964, as amended

  The Civil Rights Act of 1991

  The Age Discrimination in Employment Act of 1967, as amended

  The Rehabilitation Act of 1973, as amended

  Executive Order 11478 – Equal Opportunity in the Government

  Code of Federal Regulations Part 1200 – Merit Systems Protection Board

  Equal Pay Act of 1963, as amended

  EEOC Management Directive (MD) 110

  The Americans with Disabilities Act of 1990

  Genetic Information Non-Discrimination Act of 2008

  Alternative Dispute Resolution Act of 1996, as amended

  Pregnancy Discrimination Act of 1978

  EEO Counselors must possess exceptional verbal English language communication skills with the ability to facilitate and negotiate parties toward resolution while maintaining neutrality. EEO Counselors must also possess exceptionally strong English writing skills, with an emphasis on legal terminology, to provide comprehensive and accurate written reports, summaries and documents that are required under this scope of work.

  Candidates must possess exceptional IT proficiency with MS Office Suite, including but not limited to MS Word, TEAMS, Outlook email and calendaring and Excel.

  Strong preference is desired for candidates with current expertise with iComplaints software.

  Working Environment & Conditions

  This job operates in a professional office environment and has a noise level of mostly low to moderate. This role routinely uses standard office equipment such as computers, phones, photocopiers, filing cabinets and fax machines.

  This position is primarily indoors, consistent with a standard office position and has a noise level of mostly low to moderate. The incumbent is required to stand, walk; sit; use hands to finger, handle, or feel objects, tools, or controls; reach with hands and arms; talk and hear. The workload may require the incumbent to sit for extended periods of time. The incumbent must be able to read, do simple math calculations and withstand moderate amounts of stress.

  The incumbent must occasionally lift and/or move up to 25 lbs. Specific vision abilities required by the job include close vision, distance vision, color vision, depth perception, and the ability to adjust focus.
