The Office of General Counsel for the Massachusetts Department of Public Health (DPH) is seeking an experienced attorney to take on an exciting and timely role in the field of public health. The Deputy General Counsel will serve as legal counsel. The selected candidate will represent the department in administrative proceedings and other litigation forums for the purpose of regulatory enforcement and other litigation related matters. /_Duties and Responsibilities (these duties are a general summary and not all inclusive):_/ * Represents the department in administrative proceedings and other litigation forums while providing legal services, advice, direction, and guidance. * Represents the department at administrative proceedings, and other litigation-related proceedings as needed. * Assists programs when needed in reviewing and evaluating evidence to determine readiness for enforcement action and to advise on litigation strategy. * Drafts order to show cause, pleadings, discovery requests, motions, memoranda of law in support of motions and post-hearing briefs. * Coordinate enforcement action cases with other law enforcement agencies as needed. * Responds to discovery and public records requests and third-party subpoenas to include drafting protective orders as needed. * Drafts and negotiate settlements including but not limited to involuntary surrender agreements and consent decrees with licensees. * Complies with all state and agency rules of conduct including applicable human resources, ethics, and DPH standards. * Participates in professional development programs to hone professional competence and support the professional development of other DPH counsel. * Promotes a professional, respectful, and non-discriminatory work environment. * Collaborates with agency staff to identify and articulate policy goals. /_Required Qualifications:_/ * Membership in the Massachusetts Bar. * Knowledge of theory, principles and practices of law including methods and ability to conduct legal research and technical report writing. * Skilled in reading and interpreting legal documents and apply the laws, rules and regulations governing agency operations. * Ability to express arguments clearly and logically in oral and written forms. * Strong interpersonal and communication skills, the ability to effectively manage multiple projects simultaneously and effectively with diverse groups of people and cross-functional project teams. * Capacity to exercise discretion in safeguarding information through compliance with rules of disclosure. /_Preferred Qualifications_//:/ * At least five (5) years of legal experience, including experience in administrative litigation and health law with thorough knowledge of the Massachusetts Administrative Procedures (G.L. c.30A) and the Standard Adjudicatory Rules of Practice and Procedure (801 CMR 1.01 et seq.). * Demonstrated understanding and experience in counseling clients, legal research and analysis, oral and written advocacy, and creative problem solving preferably in an in-house or outside counsel to public agencies, private businesses, or other organizations. * A solid desire to work in a fast-paced and collaborative legal department and work independently. * Ability to create positive and inclusive environment for people from different backgrounds with a focus on accessibility, equity, and diversity. * Aptitude in analyzing, interpreting, applying facts, rules, policies, and decisions while analyzing legal problems and offering legal opinions. * Strong critical thinking, problem solving with the ability to managing relationships both internally and externally. * Proficient with Microsoft Office applications including Excel, Word, Teams, and Outlook. /_About the Department of Public Health:_/ The mission of the Massachusetts Department of Public Health (DPH) is to prevent illness, injury, and premature death, to assure access to high quality public health and health care services, and to promote wellness and health equity for all people in the Commonwealth.
