Insurance Defense Attorney Job Description
Overview
An insurance defense attorney represents insurance companies and their policyholders in legal matters arising from insurance claims. They are responsible for investigating claims, developing defense strategies, negotiating settlements, and litigating cases in court.
Responsibilities
Investigate claims: This may involve reviewing police reports, medical records, witness statements, and other evidence to determine the validity and extent of the claim.
Develop defense strategies: The attorney will analyze the facts of the case and the applicable law to determine the best way to defend the claim. This may involve arguing that the policy does not cover the claim, that the insured is not liable, or that the damages are exaggerated.
Negotiate settlements: The attorney will attempt to reach a settlement with the plaintiff's attorney to avoid going to trial. This may involve making offers of compromise or mediation.
Litigate cases in court: If a settlement cannot be reached, the attorney will represent the insurance company or policyholder in court. This may involve filing motions, taking depositions, conducting witness examinations, and arguing the case before a judge or jury.
Skills and Qualifications
Juris Doctor (J.D.) degree from an accredited law school
Excellent research, writing, and oral communication skills
Strong analytical and critical thinking skills
Ability to work independently and as part of a team
Experience in civil litigation is preferred
Experience in insurance law is a plus
Requirements - Ability to thrive in a dynamic, high-pressure environment, to prioritize client matters and adapt to quick changes while remaining diligent
Must possess analytical, legal research and writing skills
Excellent academic credentials and references
Excellent attention to detail
Excellent communication and organizational skills
Solid understanding of insurance defense
