DESCRIPTION OF THE JOB The Associate General Counsel will primarily be responsible for prosecuting administrative hearings against licensees on behalf of the Commission’s Enforcement Division. This includes researching complex legal issues related to alcoholic beverages law, negotiating with licensees, working with investigators to develop cases, conducting and responding to discovery, and preparing and arguing cases in administrative hearings before the Commission. The Associate General Counsel will also be responsible for providing regular formal trainings for the Commission’s Enforcement Division, and for other office staff on an add-needed basis, which will include the preparation of written training materials and giving in-person presentations. With the direction of the Executive Director and other members of the senior leadership team, the Associate General Counsel will also provide advice on legal issues as they arise, including in the areas of licensing and investigation to office staff. Additional duties may include responding to public records requests, responding to inquiries from members of the alcoholic beverages industry and the public, and performing any other duties as may be assigned. The Associate General Counsel must be able to work in the Commission’s current office in Chelsea Massachusetts. EDUCATION AND EXPEREINCE * Juris Doctor Degree from an accredited school of law and member in good standing with the Massachusetts Bar. * Minimum two years’ experience practicing law. * Significant experience in civil or criminal litigation with experience or expertise in managing caseloads and/or prosecuting cases. * Experience or expertise in administrative law, in general, and licensing and investigations in particular. Knowledge and understanding of the conduct of adjudicatory hearings. * Knowledge of state public records, open meetings and ethics laws. * Ability to conduct comprehensive legal research, including the ability to analyze legal precedent and apply it to factual circumstances. Ability to develop and present clear, concise and correct legal arguments. * Ability to exercise discretion in handling of confidential and sensitive information. * Excellent interpersonal skills: must be able to interact with people at all levels within the Commission, with entities and individuals regulated by the Commission, outside counsel and members of the public.
