Arkansas Attorney General Tim Griffin is seeking to hire an experienced attorney to join the dynamic team in Medicaid Fraud Division. The Medicaid Fraud Division is unique in that it can prosecute both criminal and civil cases, including Medicaid fraud and false claims, abuse, neglect, and exploitation of vulnerable persons, and ancillary charges discovered during or arising out of investigations. The team consists of special prosecutors, civil attorneys, law enforcement agents, investigators, nurses, and financial experts.

Summary
Serves as an Assistant Attorney General within the Medicaid Fraud Control Unit. The Assistant Attorney General works under the direction of the Deputy Attorney General and is responsible for handling all matters associated with the litigation and prosecution of court cases involving Medicaid Fraud and Abuse, Neglect, or Exploitation of endangered or impaired adults, as well as ancillary charges and allegations discovered during or arising out of investigations of the Medicaid Fraud Control Unit.
Functions
Reviews Medicaid fraud investigations and make recommendations as to whether litigation should be pursued.
Maintains confidentiality of MFCU investigations and safeguards the privacy of protected, sensitive information.
Attend meetings with investigators and supervisors as needed to ensure the expeditious handling of civil and/or criminal cases and proper workflow
Review and sign subpoenas
Attend investigative interviews when the facility is represented by counsel
Negotiate pre-litigation settlements
Draft complaints, settlement agreements, and demand letters.
Filing necessary complaints, motions and pleadings as it pertains to assigned civil matters and/or cases
Conducts legal research
Prepares legal review memoranda outlining the facts and legal issues pertaining to civil and/or global cases, analyzing factual and legal issues involved, and explaining the applicable legal principles and precedents, and justifying recommendations or conclusions
Responsible for all aspects of pretrial and trial preparation, including but not limited to:
• Discovery
• Witness interviews
• Court appearances
• Motion hearings
• Jury instructions
• Opening statements and closing arguments
• Direct and cross-examination of witnesses
Maintains good working relationships with other investigative, administrative, or government agencies, as well as defense attorneys, court officials, and global settlement and litigation team leaders
May be called upon to serve on Attorney General’s legislative team, review bills and draft legislation
May be called upon to assist with Criminal cases
All other duties as assigned
Dimensions
Knowledge, Skills and Abilities
Possess knowledge of state and federal laws, regulations and precedents, and knowledge of the rules of civil procedure and the rules of evidence. Possess the ability to complete work accurately with respect to legal citations, treatment of facts, and other aspects of technical treatment. Must be able to produce work that demonstrates soundness of approach and argument, application of legal principles, and that is consistent with the governing policies, procedures, and regulations of the employing agency. Must be able to plan, organize and direct the activities of others, and possess the ability to research, analyze, interpret, and apply legislation and case related information. Must possess strong writing and oral communication/ presentation skills.
Minimum Qualifications
Minimum of a Juris Doctorate from an accredited school of law. 5 years litigation and/or criminal law experience; some of both is preferred.
Licenses
Licensed to practice law in the State of Arkansas.
