Duties
This position conducts complex strategic direct investigations for compliancewith Colorado labor laws. This position determines what potential violationsto investigate, the scope of the investigation, and the best strategy forinitiating the investigation. During an investigation, this positiondetermines what information is required from employers, workers, and thirdparties, and develops the evidentiary record by obtaining information fromthese parties. This position makes strategic decisions during aninvestigation, including: how to obtain evidence from witnesses, includingthose reticent to speak to a government agency; when and whether to issuefines for failure to produce documents/information; whether, when, and how topursue a negotiated resolution; and where a violation is found, what reliefwill best redress the issue (e.g., employee/manager education, payment of backwages, prospective compliance, etc.). This position may be required to developand maintain relationships with community partners.
When the investigation is concluded, this position writes a determination andorders applicable wages, fines, and penalties; prospective compliance andremedy of past violations; and provision of information to the Division toconfirm/effectuate this compliance/remedial action. If the determination isnot appealed to the Division's administrative law judge, it is considered theDivision's final agency decision and may be published on the Division's publicwebsite. The investigator's determinations are subject to review through theDivision's appeals process and the Colorado court system. During and after theinvestigation, this position is required to collect and maintain all relevantdocumentation related to the direct investigation. In the event of an appeal,this position may attend and assist the Division representative withpreparation for appeal hearings.
In addition to these investigatory duties, this position assists the DirectInvestigations Manager, with high-level legal, strategic, and policy workimpacting the entire DI Unit and Division. The DI Unit is a relatively youngprogram that is growing and changing to improve its effectiveness andimplement lessons learned. This position is expected to work collaborativelywith the DI Team and Manager on that process. Tasks may include legal researchoften in novel areas of law requiring a creative approach to finding legalanalogs to the question at issue and memo drafting; drafting complexcitations or other documents (e.g., briefs for appeal hearings on evidence,legal arguments, or appeal proced res); amending processes and draftingtemplates; and working to shape strategies, priorities, and approaches for theDI Unit and potentially the Division.
