Job Description
AECOM is in need of a Commercial Director to work with our client TTC on some of their high-profile public Transit projects.
The job incumbent will be offered a regular, full-time position with AECOM and work on secondment to TTC. Candidate will report for work at the TTC office a few times a week for the length of the secondment. After the secondment is compete, the employee will return to AECOM to be re-assigned to another project. The home office for the employee at that time can be either the AECOM Markham or Mississauga office (with work from home options available also.)
Job Summary:
This role will be reporting to the Head of Commercial Management and be responsible for managing a team of Commercial Managers, supporting the project delivery teams in their portfolio of projects. This person needs to have had extensive experience working on target cost contracts, from Development Phase through to Implementation
Major Responsibilities:
Oversee and direct inter-related commercial work streams to ensure full commercial control is maintained
Oversee and direct the development, integration, and execution of all commercial and procurement activities, to establish contracts and frameworks for the delivery of goods and services
Oversee and direct the management of estimating and cost planning for all design stages, accounting for trends in construction and engineering industry market economics and understanding their impact
Oversee the prequalification, tender and negotiation of contracts and contract award recommendations
Lead on complex contract negotiations and achieve negotiation objectives; formulate negotiation parameters, analyze and interpret commercial market data for use in negotiation, understand when to demonstrate flexibility while also achieving negotiation objectives
Oversee and direct the management of construction, engineering, supply and service contracts; this includes communications, change control, variation/compensation event assessment, valuation/certification, remedies and close out
Oversee and direct the management of suppliers, identify and advise on potential risks to commercial agreements and supplier performance, and escalate concerns as necessary
Oversee and direct the preparation of detailed analysis of variances, earned value calculations, and associated explanations
Communicates expectations and recommendations to Senior Executives and managers, and monitors and reports on performance
Direct or support risk and value management activities, where appropriate
Represent the TTC at performance meetings with suppliers, communicate performance data, and reach agreement on improvement plans; differentiate between issues that can be managed locally and those that need to be elevated for information, resolution or action
Oversee the management of claims and mitigation, advising on the defense of claims, including analysis of the various parties’ positions
Qualifications
Minimum Requirements:
Bachelor's Degree in Legal, Engineering, or Quantity Surveying or related field of study
No less than 8 (eight) years of commercial management experience on major projects in excess of $500m and a proven track record on delivering commercial success
No less than 8 (eight) years of experience working on a variety of contract types, including target cost and fixed price contracts required
A combination of education, training, and experience deemed to be equivalent, may be considered.
Preferred Requirements:
Experience working on target cost contracts, leading the commencement through to implementation
Demonstrated experience working under a variety of standard form and bespoke contracts
Comprehensive understanding of construction methodology and process in a large, and live operating environment
Advanced knowledge of strategy development and project management practices including estimating, cost planning, project controls, and reporting
Comprehensive knowledge of applicable commercial and construction regulation, legislation, and/or case law, particularly in relation to claims management
Ability to effectively manage contracts, including communications, change control, variation/compensation event assessment, valuation/certification, remedies and close out
Proven track record with claims management and dispute resolution on major projects

Relocation is not available for this position.

Offered rate of compensation will be based on individual education, qualifications, experience, and work location: $117,000.00 - $200,000.00 per annum.
