ASSISTANT DISTRICT ATTORNEY IN APPEALS UNIT JOB DESCRIPTION * * Position Summary: The primary responsibility of an assistant district attorney in the Appeals Unit is the handling of direct appeals and post-conviction motions to ensure that valid convictions are preserved, and that justice was done. This position requires strong legal writing and research skills. Massachusetts Bar license in good standing. Major Duties as anAssistant District Attorney in the Appeals Unit: * Drafting and filing briefs for the Commonwealth; * Preparing and filing applications pursuant to Mass. R. App. P. 15 and petitions pursuant to M.G.L. c. 211, § 3; * Drafting memoranda for trial prosecutors to file in the context of ongoing trial proceedings primarily in Superior Court, but occasionally in District Court proceedings, usually involving unusual or open questions of law; * Drafting and filing responses to motions for post-conviction discovery, release, and/or new trial under Mass. R. Crim. P. 30, or for post-conviction testing of evidence under M.G.L. c. 278A; * Assisting trial prosecutors and executive staff with legal research, often under time constraints; * Oral arguments before the appellate courts, and evidentiary and non-evidentiary hearings in the trial courts, primarily the Superior Court; * Notifying trial prosecutors of significant case law and statutory amendments.
